LamiFit Terms AND Conditions

Definations :


  • “Lami.Fit “means Kaml Health Pvt Ltd, whose principal place of business is at 11G, Asset Gardenia, Ramagondanhalli, whitefield, Bengaluru-Karnataka
  • “Product Development” means research performed for the purpose of new product development and new product development activities performed by LamiFit on de-identified user data. These activities may include, among other things, improving our Services and/or offering new products or services to you; performing quality control activities; conducting data analysis that may lead to and/or include commercialization with a third party.
  • “Service”or “Services” means LamiFit’s products, software, services, and website (including but not limited to text, graphics, images, and other material and information) as accessed from time to time by the user, regardless if the use is in connection with an account or not.
  • “Personal Information” is information that can be used to identify you, either alone or in combination with other information. LamiFit collects and stores the following types of Personal Information:
  • “Registration Information” is the information you provide about yourself when registering for and/or purchasing our Services (e.g. name, email, address, user ID and password, and payment information).
  • “Genetic Information” is information regarding your genotype (e.g. the As, Ts, Cs, and Gs at particular locations in your genome), generated through processing of your saliva by LamiFit or by its contractors, successors, and assignees; or otherwise processed by and/or contributed to LamiFit.
  • “Self-Reported Information” is all information about yourself, including your disease conditions, other health-related information, personal traits, ethnicity, family history, and other information that you enter into surveys, forms, or features while signed in to your LamiFit account. Self-Reported Information is included in LamiFit Research only if it has been indicated for LamiFit Research use on the website and if you have given informed consent.
  • “User Content” is all information, data, text, software, music, audio, photographs, graphics, video, messages, or other materials – other than Genetic Information and Self-Reported Information-generated by users of LamiFit Services and transmitted, whether publicly or privately, to or through LamiFit.
  • “Web Behaviour Information” is information on how you use the LamiFit website (e.g. browser type, domains, page views) collected through log files, cookies, and web beacon technology.
  • “Aggregated Genetic and Self-Reported Information” is Genetic and Self-Reported Information that has been combined with that of other users and analysed or evaluated as a whole, such that no specific individual may be reasonably identified.

    • 1. ACCEPTANCE OF TERMS

    Your use of Lami.Fit’s Services (excluding any services provided by Lami.Fit under a separate agreement) is subject to the terms of the legal agreement between you and Lami.Fit set forth in these Terms and Conditions (“TAC”). Except as specified herein, these TAC apply to any use of the Services, including but not limited to a) submitting a saliva sample for DNA extraction and/ or epigenetic tracking and processing, b) uploading a digital version of your Genetic Information and interacting with it on the Lami.Fit app, and/or c) creating and using a free Lami.Fit account without providing your saliva sample or Genetic Information. In order to use the Services, you must first agree to the TAC. You may not use the Services if you do not accept the TAC. You can accept the TAC by (1) clicking to accept or agree to the TAC, where this option is made available to you by Lami.Fit for any Service; or by (2) actually using the Services. In this case, you acknowledge and agree that Lami.Fit will treat your use of the Services as acceptance of the TAC from that point onwards. In addition, when using particular Lami.Fit Services, you shall be subject to any guidelines or rules applicable to such services that may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into the TAC. Lami.Fit also may offer other services from time to time that are governed by different terms of service.

    2. SERVICES PRIVIDED

  • LamiDNA - Nutrition & Fitness DNA Test, helps you to understand your body better & take preventive actions to lead healthy lifestyle.
  • LamiFit Personalised Nutrition - Service related to nutritionist provided nutrition plans based on users goal, gender, deficiencies, medical and non-medical report
  • LamiDNA - Epigenetic Test, its DNA methylation test, to discover research based biological agieng
  • Lami.Fit Health App - App to access your health data, genetic data, nutrition plans, access to coaches via chat
  • Lami.Fit Smart Plans - Platform driven nutrition plans for generic diet plans, not intended for any disease or medical condition, please take advices from health practitioners before using for any medical condition. LamiFit is not responsible for mis-usages and it's repurcations

    • 3. CHANGES TO THESE TERMS OF SERVICE AND THE SERVICES

    We may revise and update these Terms of Service and post the updated Terms of Service on the Site. We will make any new terms available to you through or in connection with the affected Services. All changes are effective immediately when we post them, and they apply to all access to and use of the Services from that point onward. If you use the Services after we post revised Terms of Service, you acknowledge and agree to the revised Terms of Service. We reserve the right to withdraw or amend the Services or any portion thereof in our sole discretion without notice. We will not be liable if, for any reason, the Services or any portion are unavailable at any time or for any period. The version available online of these Terms & Conditions shall be seen as the most recent version.


    4. REGISTERING FOR AND ACCESSING THE SERVICES

    To access certain features and functions of the Services, including DNA Test, you must create a LamiFit Account. To establish a LamiFit Account, you must provide certain information that we request. This information includes:

  • your name and email address;
  • Age
  • Gender
  • Lifestyle Activity Level
  • Blood reports - only for coaches to understand your medical conditions better
  • DNA Reports - only for coaches to understand your medical conditions better
  • your billing and mailing address and phone number for product purchase

    • 5. REQUESTING DNA TEST SERVICES

    To have your DNA sequenced and/ or your gene expression analysed for use with the LamiFit Health app, you must receive and use LamiDNA kit for the collection of your saliva sample (“LamiDNA Kit”). When you send us a saliva sample using the LamiDNA Kit, you agree to the following:

  • You are submitting your own saliva sample and not the sample of another person
  • You understand that health-related interpretations are for information purposes only and not intended to diagnose or treat diseases. You should consult a physician, genetic counsellor or qualified health professional before acting on any interpretation
  • You allow LamiDNA or it's lab partner to perform analyses on your Genomic Sequencing data to generate Genetic information. You allow LamiFIt to collect, process and store the resulting Genetic Information in accordance with these Terms of Service, our Privacy Policy

    • 6. PRIVACY POLICY AND DISCLOSURE OF INFORMATION

    In order to use the Services, you must first acknowledge and agree to our Privacy Policy. You may not use the Services if you do not accept our Privacy Policy. You can acknowledge and agree to the Privacy Policy by (1) clicking to accept or agree to the Privacy Policy, where this option is made available to you by LamiFit for any Service; or by (2) actually using the Services. You acknowledge and agree that LamiFit has the right to monitor any use of its systems by its personnel at any time and maintain copies documenting such monitoring. Our Privacy Policy sets forth the only expectations of privacy any individual should have in terms of usage of the LamiFit Services, website, or other systems. We do not share any information with unaffiliated parties, except where required to provide you or your organization the ability to use the product as desired or where required to do so by law. If your LamiDNA Saliva sample has come to us from a LamiDNA Healthcare Partner or Organisation (Group), they may have access to your reports and other information


    7. PAYMENT TERMS

    LamiFit offers one of purchases together with a range of subscription plans to its Services (each, a “Plan”). Each Plan includes specific features and offers outlined within our online shop. You may select a Plan as part of your purchase within our online shop. You agree to pay the recurring payments for the total amount of time. Changes to the subscription or changes to the account are generally not possible and have to be decided on and approved by LamiFit Health Ltd on a case to case basis. It is at the discretion of LamiFit to make changes to this model at any time and for any reason. At the end of this subscription period, your Plan will automatically renew for a subscription period equal to your prior subscription period unless you provide LamiFit Health Ltd with email notice (sent to contact@lami.co.in) of your intent not to renew your Plan at least 30 days prior to the end of the current subscription period. To get further information on the specific details of your Plan, including pricing information and the end of your subscription period, please contact us at contact@lami.co.in We may change the fees of the Services at any time or impose additional fees or charges. While we do not intend to force you to pay a fee for an ongoing service higher than the one you agreed to upon purchase, we are also not obliged to lower your current fee in the event of a price drop of our Services. Changes regarding fees payable have to be decided on and approved by LamiFit Health Ltd on a case to case basis.


    8. REFUND POLICY

    You can cancel your order and request a refund by emailing contact@lami.co.in with required details like orderId, reason

    8.1 REFUND SMART NUTRITION PLAN

  • 100% Refund in case nutrition plan not uploaded
  • Post upload of the nutrition plan refund is not available

    • 8.2 REFUND POLICY : PERSONALISED PLAN

  • 100% Refund within 2 hours (Valid only in case of "NO" nutrition councelling or "NO" nutrition plan provided)
  • 90% Refund within 48 hours (Valid only in case of "NO" nutrition councelling or "NO" nutrition plan provided)
  • 80% Refund within Post 48 hours (Valid only in case of "NO" nutrition councelling or "NO" nutrition plan provided)
  • Post councelling or nutrition plan provided no refund applicable

    • 8.3 REFUND POLICY : LAMIDNA - Nutrition & Fitness DNA Test

  • 100% Refund within 24 hours (In case no shipment is done for LamiDNA Kit)
  • In case shipment done, refund will be applicable by receiving the kit back to our mailing address. post checking the kit condition refund will prcessed by deducting Rs.1000
  • After sample received & processed by the lab, no refund applicable
  • If Sample fail visual Quality check - New kit will be shared at additional Rs. 2000
  • If Sample failed DNA testing in Lab - Repeat test will be available at additional Rs. 6000
  • If Sample failed DNA testing in Lab - Refund of 50% available

    • 8.4 REFUND POLICY : PRODUCTS

  • 100% Refund within 24 hours (In case no shipment is done)
  • In case shipment done, refund will be applicable by receiving the product back to our mailing address. post checking the kit condition refund will prcessed by deducting Rs.500

    • 8.5 REFUND POLICY : B2B Partner Model Or B2B Deals

    9. GENETIC RAW DATA

  • LamiFit does not share GENETIC RAW DATA for it's any of DNA based tests

    • 10. SHIPPING

    We provide forward shipment solution for our DNA tests and products

    10.1 SHIPPING IN INDIA FOR LAMNIDNA

  • DNA kits will shipped to customer at no cost
  • Customer collect saliva at privacy of his/her own
  • Customer ship back the collected sample to Lamifit mailing address

    • 10.2 SHIPPING OUTSIDE INDIA FOR LAMNIDNA

  • Shipping charges applicable
